Scope and how this policy applies<\/h2><p>This Privacy Policy explains how <strong>Eagle Pacific Real Estate, Inc.<\/strong> (&#8220;Eagle Pacific Real Estate,&#8221; &#8220;we,&#8221; &#8220;us&#8221; or &#8220;our&#8221;) collects, uses, shares and protects personal information when you visit our websites, submit a valuation request or other form, call or text us, or otherwise interact with us online.<\/p><p>It applies to our online properties. It does not apply to the practices of companies we do not own or control, or to information you provide to a third party directly.<\/p><p>We are based in California and serve California property owners, so this policy is written to meet the California Consumer Privacy Act as amended by the California Privacy Rights Act, California Civil Code section 1798.100 and following (together, the &#8220;CCPA&#8221;). We do not need any of it to estimate what your home is worth.<\/p><p>Later in a transaction, a separate escrow, title or lender process may require identity or financial information. That collection is governed by the policies of the company collecting it, not by this policy.<\/p><\/div><p>Some answers are optional. If you would rather not say why you are considering a sale, leave that question unanswered and you will still receive an estimate.<\/p><h2>03. How we collect it<\/h2><ul><li><strong>Directly from you<\/strong>, when you complete a form, chat with our website assistant, call or text us, email us, or speak with one of our licensees.<\/li><li><strong>Automatically<\/strong>, through cookies and similar technologies when you browse the site, as described in section 13.<\/li><li><strong>From service providers<\/strong>, including an address lookup service that turns what you type into a verified address and map coordinates.<\/li><li><strong>From public and licensed sources<\/strong>, including county assessor and recorder records, and multiple listing service data, which we use to research comparable sales.<\/li><\/ul><h2>04. How we use it<\/h2><p>We use personal information to prepare and deliver your valuation, to respond to you, to provide brokerage and related services, to keep records that real estate and telemarketing law require us to keep, to measure and improve our marketing and our website, to detect and prevent fraud and abuse, and to comply with legal obligations.<\/p><p>We do not use the reason you gave for selling to set a price or to disadvantage you. We use it to understand what matters to you, for example whether speed or net proceeds is the priority.<\/p><p>We will not use your information for a materially different purpose than the one described here without telling you first and, where the law requires it, obtaining your consent.<\/p><h2>05. How we share it<\/h2><p>We share personal information only as described below.<\/p><ul><li><strong>Our licensees and staff<\/strong>, so a licensed representative can review your address and prepare your estimate.<\/li><li><strong>Service providers and contractors<\/strong> that work on our behalf under written contract that limits them to performing services for us. These include customer relationship, form and website chat tools, email and text message platforms, address lookup and mapping, web font delivery, cloud hosting, and analytics.<\/li><li><strong>Partner companies.<\/strong> Eagle Pacific Properties and the Home-Ready Program are independent companies we work with. If you ask about renovation or a direct purchase, we may share your inquiry with them so they can respond. You are never required to use them, and sharing your inquiry does not by itself authorize them to call or text you. See section 10 of our <a href=\"https:\/\/webdev.movou.com\/epre\/terms-of-use\/\">Terms of Use<\/a>.<\/li><li><strong>Transaction participants<\/strong>, such as escrow, title, lenders, inspectors and cooperating brokers, but only if you move forward with a transaction and only as needed to complete it.<\/li><li><strong>Legal and safety<\/strong>, when required by law, subpoena or court order, to enforce our agreements, or to protect the rights, property or safety of any person.<\/li><li><strong>Business transfers<\/strong>, if we are involved in a merger, acquisition, financing or sale of assets, in which case this policy will continue to apply to the transferred information until it is updated.<\/li><\/ul><p>We do not give your personal information to unrelated companies for their own marketing.<\/p><h2>06. Whether we sell or share your information<\/h2><div class=\"epre-callout\"><p><strong>OUR POSITION<\/strong><\/p><p><strong>We do not sell or share your personal information, and we have<\/strong><strong> not done so in the twelve months before the effective date of this policy.<\/strong><\/p><p>We do not use advertising or cross-context behavioral advertising tags on this website. If that ever changes, we will update this policy first and give you a way to opt out.<\/p><\/div><p>We also treat a Global Privacy Control signal from your browser as a valid request to opt out of sale and sharing for that browser and device.<\/p><p>We do not have actual knowledge that we sell or share the personal information of consumers under sixteen years of age.<\/p><h2>07. How long we keep it<\/h2><p>The CCPA requires us to tell you how long we keep each category, or the criteria we use to decide. Records subject to a legal hold are kept until the hold is lifted.<\/p><h2>08. Automated decision-making<\/h2><p>A licensed representative reviews every valuation before it is sent to you. We do not use automated processing alone to make a decision that produces legal or similarly significant effects about you, and we do not use your information to train a third party&#8217;s artificial intelligence model.<\/p><p>We do use software to assemble comparable sales and to organize inquiries. That software supports a person&#8217;s judgment rather than replacing it.<\/p><h2>09. Your California privacy rights<\/h2><p>If you are a California resident, you have the following rights.<\/p><ul><li><strong>Right to know.<\/strong> Request the categories and specific pieces of personal information we have collected about you, where we got it, why we collected it, and the categories of parties we disclosed it to.<\/li><li><strong>Right to delete.<\/strong> Request that we delete personal information we collected from you, subject to the exceptions the CCPA allows, including our record retention duties under real estate and telemarketing law.<\/li><li><strong>Right to correct.<\/strong> Request that we correct inaccurate personal information.<\/li><li><strong>Right to opt out of sale or sharing.<\/strong> Direct us not to sell or share your personal information, as described in section 06.<\/li><li><strong>Right to limit use of sensitive personal information.<\/strong> We do not collect sensitive personal information through this website for purposes that trigger this right, but the right is yours if that ever changes.<\/li><li><strong>Right to access information about automated decision-making<\/strong>, as described in section 08.<\/li><li><strong>Right to non-discrimination.<\/strong> We will not deny you service, charge you a different price, or give you a lower quality of service because you exercised any of these rights.<\/li><\/ul><p>California Civil Code section 1798.83, the &#8220;Shine the Light&#8221; law, separately lets California residents ask once a year about personal information disclosed to third parties for those parties&#8217; own direct marketing. We do not make those disclosures.<\/p><h2>10. How to make a privacy request<\/h2><div class=\"epre-callout\"><p>Call <strong><a href=\"tel:+18335213773\">(833) 521-3773<\/a><\/strong> or email <strong><a href=\"mailto:info@eaglepacificrealestate.com\">info@eaglepacificrealestate.com<\/a><\/strong> with the subject line &#8220;California Privacy Request.&#8221;<\/p><p>We confirm receipt within ten business days and respond within forty five calendar days. We may take up to another forty five days if we tell you why within the first period. There is no charge unless a request is manifestly unfounded or excessive.<\/p><\/div><p>We verify your identity before acting, usually by matching two or more pieces of information you have already given us. For a request to know specific pieces of information, we verify to a higher degree of certainty. If we cannot verify you, we will tell you and will treat a deletion request as an opt out of sale or sharing where that is appropriate.<\/p><p>An authorized agent may submit a request for you with written permission signed by you, and we may still ask you to verify your own identity directly.<\/p><p>If we deny your request, we will tell you why and how to appeal.<\/p><h2>11. Your choices about messages<\/h2><p>You control how we contact you, and you may tell us to stop by any reasonable method that clearly says so. We will not insist on one particular channel.<\/p><ul><li><strong>Text messages.<\/strong> Reply <strong>STOP, QUIT, END, CANCEL, UNSUBSCRIBE, OPT OUT<\/strong> or <strong>REVOKE<\/strong>. Reply <strong>HELP<\/strong> for help.<\/li><li><strong>Marketing email.<\/strong> Use the unsubscribe link in any marketing email, or tell us directly. We may still send transactional messages about an active transaction.<\/li><li><strong>Calls.<\/strong> Ask any representative to add you to our internal do not call list, or call <a href=\"tel:+18335213773\">(833) 521-3773<\/a>.<\/li><li><strong>Anything else.<\/strong> Tell any of our representatives, in any channel, in your own words.<\/li><\/ul><p>We honor a revocation as soon as practicable and in every case within <strong>ten business days<\/strong>. We maintain an internal do not call list and honor entries on it for at least five years, as federal rules require.<\/p><p>At present, opting out of text messages does not automatically stop marketing email, and the reverse is also true, so please tell us if you want both to stop. From <strong>January 31, 2027<\/strong>, a single opt out will stop all marketing calls and texts from us.<\/p><h2>12. Consent records for calls and texts<\/h2><p>When you check the consent box on a form, we store a record of that consent so we can prove it later. The record includes the exact wording you agreed to, the date and time, the web address of the page, and your browser user agent string.<\/p><p>We keep this record because the Telephone Consumer Protection Act, 47 U.S.C. section 227, places the burden on us, not on you, to show that consent was given. We use it for no other purpose and we do not sell or share it.<\/p><h2>13. Cookies, analytics and web fonts<\/h2><p>We use cookies and similar technologies to keep the site working, remember your progress through a form, measure traffic, and understand which marketing brings people here.<\/p><ul><li><strong>Strictly necessary.<\/strong> Required for the site and its forms to function. These cannot be switched off.<\/li><li><strong>Analytics.<\/strong> Aggregated measurement of how the site is used.<\/li><\/ul><p>Two third party services load automatically on our pages. An <strong>address lookup service<\/strong> receives what you type into the address field so that it can suggest matching addresses. A <strong>web font service<\/strong> receives your IP address so your browser can download our typefaces. Each is operated by a company outside our control and under its own privacy policy.<\/p><p>Most browsers let you block or delete cookies in their settings. Blocking strictly necessary cookies may break parts of the site. We honor the <strong>Global Privacy Control<\/strong> signal as an opt out of sale and sharing. We do not respond to other Do Not Track signals, because no common standard for them has been adopted.<\/p><h2>14. How we protect it<\/h2><p>We use administrative, technical and physical safeguards intended to protect personal information, including encrypted connections for all form submissions, access limited to people who need it, and written contracts with our service providers.<\/p><p>No website or method of transmission is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you as California Civil Code section 1798.82 requires.<\/p><p>Please do not send sensitive information to us by ordinary email, which is not a secure channel.<\/p><h2>15. Children<\/h2><p>This website is intended for adults. We do not knowingly collect personal information from anyone under sixteen. If you believe a child has provided us information, contact us and we will delete it.<\/p><h2>16. If you live outside California<\/h2><p>This website is directed to property owners in California. If you contact us from another state that gives you privacy rights similar to those in section 09, tell us when you make your request and we will honor the equivalent right where the law requires it.<\/p><p>We do not offer services in the European Economic Area or the United Kingdom and do not target users there.<\/p><h2>17. Changes and how to reach us<\/h2><p>We may update this policy. The effective date at the top of the page shows when the current version took effect. If we make a material change we will post a prominent notice on this page, and where the law requires it we will contact you directly.
